SUMMARY:
The 2025 Annual Report of the Ombudsman of the Grand Duchy of Luxembourg, the first to be published during Claudine Konsbruck’s term in office, highlights a year characterised by a sharp rise in complaints and persistent shortcomings in the functioning of the administration. The report is structured around the Guidelines for Good Administrative Conduct, reiterating that the administration must remain accessible, people-centred and focused on serving the public. Numerous difficulties are highlighted, notably excessive delays in processing cases, a lack of clear and personalised information, and rigid or ill-founded administrative practices. Cause for concern is also noted in sensitive areas such as immigration and asylum, reception conditions for refugees, social law, health, housing and access to benefits, with consequences that are sometimes serious for those affected.
The report sets out three key recommendations: the introduction of a right to make a mistake for citizens acting in good faith; a reform of the law on parentage to ensure equality for all children and families; and the recognition of an effective non-contentious remedy against administrative fines, particularly those imposed by the Labour and Mines Inspectorate (ITM).
The Ombudsman consistently advocates for a more proportionate, transparent and preventive approach to public action, prioritising dialogue and corrective measures rather than sanctions. Through numerous concrete cases and detailed statistics, the report emphasises the need to strengthen legal certainty, public trust and the quality of public services, whilst reiterating that behind every case there is a person whose rights must be respected.
